Terms & Conditions
These Terms and Conditions (“Agreement”) govern the provision of web hosting services (“Services”) by Bluecane Technologies, LLC (“Provider”, “we”, “us”, or “our”) to you (“Client”, “you”, or “your”). By using our services or making payment, you agree to be bound by this Agreement.
1. Services Provided
We provide web hosting services as outlined in the selected hosting plan. Services may include server space, bandwidth allocation, email accounts, SSL support, and related technical services.
2. Fees & Payment Terms
- All fees are billed in advance, either monthly or annually, as agreed upon.
- Payments are due upon invoice issue or by the due date stated.
- Late payments are subject to a 3% monthly late fee or suspension of services after 14 days of non-payment.
- Reinstatement of suspended accounts may incur an additional reactivation fee.
3. Client Responsibilities
- You are responsible for your content, website updates, backups (unless included in your plan), and securing account credentials.
- You must not use our services for illegal, abusive, or unethical activities, including but not limited to:
- Hosting malware, phishing, or pirated content
- Sending unsolicited emails (spam)
- Infringing copyrights or trademarks
- You agree not to exceed the resource limits of your plan. We may throttle, suspend, or terminate your account if it negatively affects server performance or other customers.
4. Service Availability & Uptime
- We aim to provide 99% uptime excluding planned maintenance or events outside our control (e.g., DDoS attacks, ISP failures, natural disasters).
- Scheduled maintenance will be communicated at least 24 hours in advance.
5. Data Backup & Recovery
- Routine backups may be provided but are not guaranteed unless explicitly included in your hosting plan.
- Clients are solely responsible for maintaining current copies of their website data and files.
6. Account Suspension & Termination
- We reserve the right to suspend or terminate services for:
- Non-payment
- Violation of these terms
- Activities that jeopardize server stability or security
- You may cancel services at any time with 60 days’ written notice. No refunds are issued for unused service time unless required by law.
7. Limitation of Liability
- We are not liable for indirect, incidental, or consequential damages including data loss, business interruption, or loss of revenue.
- Our total liability is limited to the total fees paid for hosting in the past 30 days prior to a claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless [Your Company Name], its officers, agents, and employees from any claims or liabilities arising from your use of our services or violation of this Agreement.
9. Amendments
We may update these Terms & Conditions with notice. Continued use of services after updates constitutes acceptance of the new terms.
10. Governing Law
This Agreement shall be governed by and construed under the laws of Florida/USA. Disputes shall be resolved in the courts located in Broward County.
